There is a person targeting the elderly in several counties including
Citrus, Pasco and The Villages (that we are sure of). He has been
doing it for several years with no consequences. His latest targets,
in New Port Richey, were just before Christmas 2009.
The company name is Nick Stanko Masonry. His address is 13097 Linzia
Lane Spring Hill, FL. His phone number is 352-875-5385. His flyers
state he is licensed (occ Lic#00564055) but that is false. He also
states his work is guaranteed including a 10 year guarantee. He
has yet to return to any of the victims asking for the work to be
done properly, yet he promises each one that calls that he will
return to correct the problem.
He approaches the people at their home and tells them he can make
their driveway 'look like new'.
He applies various coatings, collects the amount agreed upon (1,000's
of dollars -cash when possible), then a few days later the people
realize what a shoddy job was done. They contact him, explain the
job is not satisfactory, he promises to return but NEVER does.
Every state and county agency has been contacted and all say he
doesn't need a license so there is no recourse. Every handyman I've
talked to needs a license, why not this guy?
The Department of Agriculture has been sent complaints, it has been
sent on to an investigator but it was made quite clear not to expect
any answers any time soon. This is unacceptable.
These people have been and continue to be scammed. Several TV stations
have run stories on this operation yet he is still out there, targeting
the elderly, taking their hard earned money, then he laughs at them
when they complain.
Even if the license is not needed, which we find hard to believe,
fraud is still a crime. In a broad strokes definition, fraud is
a deliberate misrepresentation which causes another person to suffer
damages, usually monetary losses. Most people consider the act of
lying to be fraudulent, but in a legal sense lying is only one small
element of actual fraud. A salesman may lie about his name, eye
color, place of birth and family, but as long as he remains truthful
about the product he sells, he will not be found guilty of fraud.
There must be a deliberate misrepresentation of the product's condition
and actual monetary damages must occur.
What can you do to help put this guy out of business and held accountable
for all the people he has hurt?
